About the screenshots, some fine tuning in the size could be done, perhaps with adding an auto-thumbnail feature with an onclick ajax effect (as long as i can remember there is a hack available on zoullou's website, and kris has already implemented such a feature somewhere)

I like the new style gallery - especially as there are previews of the 'full length' theme. Makes comparing themes so much easier

Sugestions:
* Add theme name in top of thumb.
* Credits +1
* Reduce columns to remain 1024 width aspect
* I can see all themes comes from same source, I suppose themes from another designers/source will be integrated later +1

- download e-card & download original is unnecessary
- make it 3 col instead of 4..the zeta layout is streched
-Maybe this can be change Categories / Albums Nb Albums Nb Photos to reflect it as a theme gallery not as photo album

Yes, Burning is doing some really cool stuff. The challenge for us is now to make it available to as many people as possible by using it over here (the Theme Gallery) and by translating his Tutorials into different languages...

Publishing my themes on your website without my credits is one thing... i can overlook that, but redistributing my themes without my knowledge and permission is a direct violation of the license agreement that must be approved to download and use any of my themes.

If the blatant theft of my intellectual property is not rectified, you will be hearing from my lawyers.

I absolutely do not mind that my work is displayed, I released it for free to this community with the stipulation that my license would be adhered to, and this is simply not the case.

Again, you must either remove my work from your repository, or direct all downloads to my website.

Clearly you know nothing about GPL - it does not apply to graphical work. I have every right to release my work under an independent license, which I have done now for some time.

I suggest you try and get a grown up to translate the GPL license for you, and perhaps the exceptions.

(you can't just read the first paragraph of something and expect to understand it...)

There is also a forum thread on this very website that mentions this.

Stop accusing me of ill doing - this is a legal matter between myself, xoops, and kris, and has nothing to do with anything else that has occurred between Mamba and myself, or instant zero.

Or please continue to violate my license and I will see you all in a MD State courtroom, (per my license agreement). It is nice here this time of year, you will enjoy it.

The 3 themes of mine that you're hosting are old versions....as you can see in the preview, they do not display properly in XOOPS .14+....the versions on my website are fixed and do display properly. (my site is down for a couple hours to perform some updates, you're free to grab the new versions when its back up shortly)

Question: How do you plan to deal with theme version updates like this? I mean, is someone going to have to get ahold of Kris every time they update their theme?

About GPL and templates, don't forget that templates needs xoops, and smarty to run. install it on drupal, it doesn't work directly. so the solution is not so direct (check FAQ). Moreover, it relies on the local laws, since we are in an international context.

its not about that burning, I want my rights as an artist to be respected.

If you guys would have just asked it would have been a different story altogether, as I am no longer able to do themes for xoops, and I would still love to see that old work of mine put to good use.

However it is not the case, my work is blatantly being stolen and redistributed, and the response here is as always, if someone has a problem their account gets banned.

Therefore, i want my terms to be adhered to or my work to be removed.

We'll have people who will maintain the Theme Gallery so you can notify them about updates. Or one of the XOOPS Moderators. In the future we'll try to find a solution where you will be able to maintain your contributions directly.

To be honest, I was always wondering why some graphic designers think that they are "different" from software developers. Systems like XOOPS, Joomla, Drupal are released under GPL, and people spent hundreds/thousands of hours to write code, and the code they release is automatically licensed under GPL and everybody can use it and modify it.

So why would graphic designers require a special/different licensing? Do they think that code writing doesn't require creativity or brains, and that their work is more important/creative or whatever, and therefore their "graphic works" require a special license protection? This issue is not unique to XOOPS, as similar issues were raised in Joomla and Drupal communities.

XOOPS/Joomla/Drupal don't require to pay for removal of the link to their respective Websites, but some graphic designers want to get paid for removal of the link to their Website. We don't use copyright laws to protect from modifications, we encourage it, but these graphic designers don't want you to touch their graphics and modify them.

This seems to be against the Open Source spirit and the equality among contributors to these projects. It's like creating a class/caste system, where some are more equal than the others.

So to ensure the equality among all of us contributing to XOOPS, we'll follow the Wordpress model for submissions, i.e. all themes submitted to the XOOPS Theme Gallery have to be GPL compatible. This will ensure that copyrights are protected and credits are given where they are due, but will also ensure equality among all XOOPS contributors.

This will also make life easier for our users, as they won't have to think if they can or cannot use/modify freely a particular theme on their Website.

Based on that, we've removed Mr. Theme's theme from our Theme Gallery on his request, as it was not GPL compatible.

Please note that we are encouraging providing paid services to people who are looking for customized XOOPS solutions. But we feel that if something is released to the XOOPS community, it should be released under GPL. This is similar to Joomla, Drupal, and Wordpress approach.

Please also note that even if you release a theme under a different license, the PHP and Javascript portions have to be released under GPL. The graphics, CSS and HTML can be released under the other license, unless they are based on GPL materials.

Well, this is purely my opinion, but, to try and answer the questions you posed:

Its a thin line of respect of the theme author that a lot of people readily cross without thinking twice. There have been hundreds upon hundreds of themes for every CMS that people have taken, slapped their name on and SOLD as their product....its very very common. Hundreds of people have even made successful businesses out of selling other people's themes as their own. Most of the time, if someone pirates a theme and distributes it as their own, it's very very difficult to track down the original author, its even harder to tell when you rip a XOOPS theme and sell it for phpnuke, which is also common....whereas you could look at source code and say "hey, that came from xoops" (take phpmyspace gold for example, easily identified as xoops).

For every 1 CMS in existence, there are well over 1,000 themes for different CMS's, and even that's probably a conservative estimate....Identifying ripped themes is comparable to trying to find a needle in a stack of needles. I'm not saying its impossible to rip software, I'm just saying that the "average joe" couldn't possibly rip XOOPS and sell it as their own, but theres a 99% chance good ol joe can turn a buck on my theme that I released freely on XOOPS just by modifying a single html file. Coders practice license overriding as well...theres plenty of code snippets that have similar licenses....look around on hotscripts for example....theres TONS of "donationware" for a variety of GPL CMS's...donationware meaning: "send me money and you can remove my credit". There are also GPL CMS module/hack coders that will do everything in their power to prevent you from removing their credits...Ive seen die scripts in nuke-fork modules that kill the CMS if you remove or modify a copyright in a module.

It's not really about modification at all. You can take any one of my themes, color it pink and put a hat on it for all I care, but it's still my theme. You didn't make it, I did, you just colored it pink and put a hat on it, but could say it was yours and _most_ people wouldnt know the difference. Thats where the problem is, with a theme, it's far too easy to attribute credit to yourself when credit is due to someone else...whereas in open source software, a creative google search can identify rippers in some cases. Themers can _make an effort_ to protect their intellectual property by licensing their product separately. It's not about "i don't want to release this under GPL", its about "how can I release this and still protect my right as the original author".

And as a side note, I respectfully ask that what I just said isn't used as fuel for a flame war.

I still don't see the difference between code and graphics. The coder spends 5 hours writing code, you spend 5 hours designing a theme. Both of you release it. For both of you there is a chance that somebody will violate your copyright and will try to sell it as his own.

If you release the theme under GPL, and somebody sells it, they should include the Copyright notice and GPL files. If they remove it, then they will violate GPL the same way as if they would remove the copyrights notices from the code.

If it happens, both of you invested the same amount of time, the copyright of both of you has been violated, so what is the difference that would justify a different license for the graphic designer?

There always will be some unethical people who will violate other people's copyrights. When I do something for Open Source I'm not thinking about those people, but about those who will use in a positive and ethical way.

If it's not about modification, but about copyright protection, then what is the difference between releasing something under GPL and, let's say, Will's license? In both cases you can sue the person who violates your copyright. And I don't think that courts will pay more attention to Will's license than to GPL, if it's only about "ensuring copyright".

I continue to have serious reservations about graphic designers trying to have a better status than programmers in the "Open Source" area.

If we all are supporting Open Source, GPL should be good enough for both of us. If it's about money, I can understand that graphic designers want to have a more restrictive license. But is it fair then to make money on backs of developers who give their time as source code to the community for free? Is it still then the same "Open Source idea" for both of us?

Just my personal opinion, but I'm willing to learn more about it...

Functionally, I think the themes gallery is better than the old library - but it has some room for improvement. Use tags or keywords to help users find themes that are a specific color, fixed or flexible, style, number of columns, etc. ChurchBeauty has a great structure for looking at site designs.

About the other discussion (basically an intellectual property or digital rights management issue) - there are lots of opinions available, so I won't offer mine. But, I will ask a few questions, only for reflection, not for response...

If I provide you with a set of tools and you build an architectural marvel - who has more value?

What is more important - the paint, the painting, or the painter (or is it the canvas or the frame)?

In America, there are different forms of protecting things you create - copyrights, trademarks and patents are just a few. Which is stonger? Which is appropriate? Do any of them matter if we respect each other?

Burning just updated it with some requested features (links to the author, number of columns in the theme), and added some new themes. There will be few more changes coming in the near future (e.g. lightbox)...

It's all there - you have to click on the picture, and then you'll be transferred to more details...

Ok Mamba, I see theme name in public-photo.php (not too obvius). But I still can't download the theme itself, just a .png

What I was looking at is public-album.php, I think theme name must be below thumbs and a link to compressed download theme.

But when you gave me yours files, I have got a lot of troubles :
- with facebox script (I can't manage to make it works )
- with screenshot size, wich I tried to enlarge a little

... so now it's why there is a lot of bugs and html / css code is not clean.

I've just finished this evening to upgrade theme library, 10 themes added :

- green-grass
- Industrial
- phoenix
- Primitive
- shopping
- tomandjerry
- whbrasil_vs1
- whbrasil_vs2
- Xorange
- zetagenesis (missing )

It was a bad time for me back then cause i was packing all sh*t as we moved and took like 2weeks for my internet connection to be moved to the new home, however send me the already modified files by you and I'll have them fixed.

My only reason for bringing this up was cause news article was modified from its original format!

Therefor all themes on my site now require registration for a user to access them, all future themes will be licensed in a way that will forbid their availability on other sites!

This article was the first one, and at that time all work was done by Burning. After that you've got involved and helped us with the GUI, and we gave you full credit in this follow-up article:
